A Review Of The Legal Regulation Of Climate Change In Kenya

Abstract

Myriad international instruments and domestic legislations have been enacted in the global arena and in Kenya to directly and indirectly tackle the climate change phenomenon. These include the United Nations framework Convention on Climate Change (1994), the Paris Climate Agreement (2016), the Kenya National Climate Change Action Plan (2013-2017) and the Climate Change Act (2016). Therefore, this study is anchored upon the view that despite the existence of significantly adequate legal provisions (both in the arena of Kenyan Municipal &International Law which applies in Kenya by virtue of the 2010 Constitution12) to combat climate change, there still persists the ever-present problem of implementation/enforcement of such regulatory measures. This research will attempt to unearth the reasons why efforts to mitigate the effects of climate change are hindered by lack of the requisite sufficient enforcement resulting into numerous negative effects.
