Abstract:
The situation in Kenya is exactly different from what the law provides. The law provides for the right to life as a constitutional right that is guaranteed to all citizens except with the limitations that are provided by law.9 Further, the right is also enshrined in international instruments like the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR), the African Charter on Human and People's Rights (ACHPR). The International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED) hence, there are no justifications to human rights injustices like extrajudicial killings and enforced disappearances and the laws have been put in place to cater for all, including the State and its organs but still these violations happen and no repercussions whatsoever. Why are the laws to be adhered to being followed selectively? My problem is what the State is doing for the increasing number of cases in extrajudicial killings and enforced disappearances and why the State would let such injustices go without the 'right to be heard'? The State should be at the forefront agitating and fighting for the full protection of its citizens’ rights and not the ones who take away life that is guaranteed in a merciless and inhumane manner, without any dignity or honour.
