A Legal Analysis of Sports Management in Kenya

Abstract

In Kenya, sports management undergirded in law by the 2010 Constitution under schedule four, the sports act, Kenya Institute of Curriculum Development Act and Anti-doping Act. Under the Fourth Schedule to the 2010 Constitution, both the national government and counties are mandated to address sports issues in the country. The Fourth Schedule deals with the distribution of functions between the national government and counties. The national government has the mandate to promote sports and sports education while counties are responsible for sports, cultural activities and facilities. The national government is obligated to devolve resources for sports to the counties. This means county governments are able to invest in sports development. This is the basis for the establishment of sports stadia by counties that has been witnessed in various counties such as Machakos and Mombasa. It is submitted that nothing in the Constitution precludes counties from establishing sports academies for training sportspersons in various sports. This paper will also further undertake an It proposes that these challenges are critical and should be looked into account and implemented into law to accommodate everyone who is interested in sports as stipulated in the Constitution. It further proposes how the government can deal with these issues in order to fairly promote sports to everyone and observe the critical legal requirements.
