Abstract:
People have haunted animals all over the world for different reasons. Some for substinence, others as a rite of passage and others for the parts which they use in cultural rituals. The issue of poaching has been present in the world even before colonialism. It came about by the introduction of hunting laws to protect property rights. As time passes by, the number of animals walking the earth is slowly but surely reducing and this is not only contributed by exterior factors such as climate change or disease but by human activity. The motivations for poaching are numerous in number and whatever those may be, if drastic measures are not taken to revise the systems put in place to protect wildlife, soon there will be nothing to be proud of but a few animals put in cages.
The proposal of this study is aimed at introducing the reader to the research as a whole by setting a context within the Kenyan jurisdiction through the background and building a foundation of the research by theoretically explaining the rationale behind protection of wildlife and establishing the justification of the study. Through the research objectives, questions and the statement of the problem, the researcher narrows down the areas of focus in order to give the reader direction in the flow of reasoning. After the proposal are four other chapters hat tackle the objectives one by one leading up to a well versed conclusion. This study breaks down the origin of poaching, the Kenyan legal frame work and compares this with the legal framework of Botswana and South Africa. All this is with an aim give solutions with a different perspective than using force against poachers.
