Abstract:
This study is primarily based on the experiences and views of the local mwananchi (as he is commonly referred to in Kenyan parlance), coupled with the body of the law on one hand, and the workings of the court process on the other. A good number of Kenyans do not seem to know the basic context of the law, leave alone the wavering cloud of disinterest and even bewilderment if they find themselves subject to the court process while pursuing justice.
